TIPS:
- Review your job descriptions annually and have legal counsel approve
- The more detailed you are in advance, the better chance you have to hire correctly, evaluate employees performance and protect your company from future lawsuits!
- Use gender neutral language (sales person vs. salesman)
- Avoid age related language (don't quote # of years of experience but use words to describe the level of experience such as "substantial" or "proven background"
- State on the description that the position is an "At Will Position" (except in Montana)
- Do not use the word "PROBATIONARY" as it can imply a contract
- Never use the words "Permanent" as it implies forever
- Even though many sales people are required to meet face-to-face with clients, it is not advisable to include "Valid drivers license" or "must have car", the recommended verbiage is "must be able to provide transportation to meet required weekly face-to-face client appointments"
Always have an up dated handbook and have new employees sign receipt stating they have received a copy. This can help eliminate discrepancies and lawsuits.
Again, have all documents reviewed annually by a qualified attorney!
